Tim Espinosa Music provides bespoke violin performance services for luxury weddings, private events, and curated entertainment experiences. Services may include live performances, consultations, custom packages, and personalized music curation tailored to each client’s event.

3. User Conduct

You agree not to:

  • Use the Services for any unlawful, harmful, or fraudulent purpose.

  • Interfere with or disrupt the operation of the Services or servers.

  • Use automated systems or means to access the Services without prior written permission.

4. Booking & Payment Terms

  • All bookings require a signed agreement and a non-refundable deposit to secure the event date.

  • Full payment must be received no later than fourteen (14) days prior to the event date unless otherwise agreed to in writing.

  • Accepted payment methods include bank transfer, credit card, or approved digital payment platforms.

  • Failure to remit payment by the required deadline may result in cancellation of services without refund.

5. Cancellation & Refund Policy

  • Deposits are non-refundable under all circumstances.

  • Cancellations made more than thirty (30) days prior to the event date may be eligible for a partial refund of amounts paid beyond the deposit; any such refund is offered solely at the discretion of Tim Espinosa and is not guaranteed.

  • Cancellations made within thirty (30) days of the event date are not eligible for any refund.

6. Client Responsibilities

Clients are responsible for ensuring:

  • A safe and appropriate performance environment.

  • Reasonable access to the venue for setup and breakdown.

  • Adequate shelter for outdoor events and protection from weather-related conditions.

  • Reliable power sources where amplification or electronic equipment is required.

Tim Espinosa is not responsible for performance limitations caused by venue restrictions, weather conditions, or inadequate event logistics.

7. Substitution & Performance Contingencies

In the event Tim Espinosa is unable to perform due to illness, emergency, or circumstances beyond reasonable control, Tim Espinosa Music will make reasonable efforts to provide a qualified substitute performer, subject to availability and client approval. If a substitute is not available or accepted, liability shall be limited as outlined in these Terms.

8. Intellectual Property

All music arrangements, recordings, videos, photographs, written content, branding, and promotional materials associated with Tim Espinosa Music are the intellectual property of Tim Espinosa Music and may not be copied, distributed, reproduced, or reused without prior written consent.

9. Privacy Policy

Personal information is collected solely for the purpose of providing services, enhancing the client experience, and maintaining internal records. Tim Espinosa Music does not sell or share personal information with third parties except when required by law or when working with trusted partners essential to service delivery (e.g., event planners, venues, or audio engineers).

10. Force Majeure

Tim Espinosa shall not be held liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to acts of God, severe weather, illness, pandemics, government restrictions, transportation disruptions, labor disputes, or venue-related issues. In such cases, reasonable efforts will be made to reschedule services or provide a suitable alternative where possible.

11. Limitation of Liability

To the fullest extent permitted by law, Tim Espinosa shall not be liable for indirect, incidental, or consequential damages arising from the use of or inability to provide Services. Total liability, if any, shall not exceed the total amount paid by the client for the Services.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

13. Changes to These Terms

Tim Espinosa reserves the right to update or modify these Terms at any time. The most current version will be posted on the website with the updated effective date.
